GREAT EATS TERMS & CONDITIONS FOR ADVERTISERS
Advertisers using the Great Eats site acknowledge that the following conditions of use shall apply and they agree that they are bound by these terms and conditions.
COPYRIGHT AND TRADEMARKS
All information, text, graphics, photographs and other material displayed on www.greateats.com.au are protected by copyright. Reproduction or distribution of any information, text, photograph or graphic without written permission is prohibited. All rights reserved.
Great Eats related companies has propriety rights and copyrights over all the contents, which include that of, icons, materials, concepts, data, graphics, logos, page headers, button icons, scripts, and service names and other marks and information indicated on our Great Eats site.
Advertiser’s use of the Great Eats site does not confer advertisers a license or any other rights with respect to the trademarks, service marks, copyright, or other intellectual property or proprietary rights in or on the Great Eats site.
If you are dissatisfi ed with any Great Eats site content, or with the access agreement to the Great Eats site, in whole or in part, you’re sole and exclusive remedy is to discontinue using the Great Eats site
LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES
Under no circumstances shall Great Eats, its parent companies, or affi liates, or their respective directors, offi cers, employees, agents, contractors, or licensors, be liable to you or any other third party for any decision made or action taken by you in reliance on the content contained within the Great Eats web site or the content contained within any internet site linked to or from the Great Eats site.
We exclude all representations, warranties and conditions of any kind whether express, implied, statutory or otherwise, information, contents or materials; and liability including negligence to you or anyone else in respect of any loss or damage, (including special, direct, indirect, punitive, consequential loss or damage such as loss of revenue, loss of reputation, unavailability of systems, inaccuracy of data or loss of data and other matters to that effect) arising from or in connection with any use of the information on or access through the Great Eats site (including, but not limited to third party content and the third party web sites) for any reason whatsoever, even if Great Eats has been advised of the possibility of such damages.
We do not have and never intended to have any contractual involvement in your bookings or other dealings with the users on our Great Eats site.
Advertisers agree that the use of the Great Eats site is at your own risk. Great Eats is harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Great Eats site, or resulting from the content or materials that you supply.
In addition, the content within the Great Eats web site and the content within internet sites linked to or from Great Eats may include technical or other inaccuracies or typographical errors, changes are periodically added to the content herein; these changes will be incorporated in new versions of the Great Eats site and specifi cally are included in this section agreement. Great Eats and its contributors may make improvements and/or changes in the content at any time and from time to time.
Advertisers agree to use the Great Eats site for lawful purposes. Users are prohibited from posting on or transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law whatsoever.
INTELLECTUAL PROPERTY
Advertisers shall not download (other than temporary copy in your computer’s cache), reproduce, publish, use, print, exploit, duplicate, use, copy, modify and make adaptations or adaptations of, any of the content on the Great Eats site in any manner except with explicit written consent from Great Eats management.
Advertisers shall not resale or use any contents on the Great Eats site for commercial use; any restaurant’s data, reviews, comments, ratings, restaurant listings, descriptions, users’ names, user’s account information, any derivative use of the Great Eats site or its contents, downloading or copying of user’s information by any means whether manual, use of data mining software or data gathering tools for the benefi t of any commercial use.
Advertisers shall not use the Great Eats logo or other graphic as the link or part of the link without explicit consent from Great Eats. Advertisers are permitted to print copies from the Great Eats site for the sole purpose of private use only.
CONSENT TO FORWARD YOUR ADVERTISED DETAILS
Please keep in mind that whenever you voluntarily disclose personal information online - for example in ads that you post or through email - that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.
Upon you submitting or posting your content or materials, you grant the Great Eats site and its affi liates a royalty-free, perpetual, irrevocable and full right to use, reproduce, modify, adapt, publish, translate and create derivatives works from, distribute and display such content worldwide by whatsoever means.
Upon advertisers submitting or posting content or materials, Great Eats and its affi liates are granted the right to use the name that you submit with regards to such content and materials.
If advertisers consent to receiving information from companies other than Great Eats, we would forward your personal details to selected reputable companies that we think will be of interest to you.
Advertisers may request us to unsubscribe your name from the Great Eats marketing database at any time. Great Eats will not disclose your personal information, except in circumstances in which it is necessary to do so or where permitted by law.
We may disclose your personal information to the following parties:
• An agent acting on your behalf;
• Collection agency or party used to determine creditworthiness;
• Law enforcement agencies;
• Privacy or Telecommunications Ombudsman.
YOUR E-MAIL, USER NAME, PASSWORD ACCOUNT
Advertisers shall not use a false e-mail address, and impersonate any person or entity.
Advertisers are responsible for maintaining the confi dentiality of your account, user and password and you shall accept all responsibilities that occur under your account, user name and password.
REVIEWS, RATING AND OTHER CONTENTS INCLUDING ACCURACY OF INFORMATION
The Great Eats site has been prepared solely for the purpose of providing information about eating venues and the services and products they offer.
The Great Eats site has been compiled in good faith, no representation is made as to the completeness or accuracy of the information it contains.
This information may be incomplete, may contain errors or may have become out of date. Advertisers contributing to the Great Eats site will be responsible for anything that is published, posted.
We do not approve of or condone any statements, opinions, ratings, reviews, materials or contents that you publish.
We do however reserve the right (but not the obligation) to remove, withhold, edit, rephrase, and monitor reviews, comments and materials before posting them on the Great Eats site
